Certified Legal Assistant (CLA) & Certified Paralegal (CP) Examination Test Preparation Study Guide


The CLA/CP exam was established in 1975 and is now the première certification procedure for paralegals. The exam is developed and administered by the Board for Legal Assistants.

Format Of The Certified Legal assistant/ Certified Paralegal Examination (CLA/CP):


The PLA/CP exam is divided into following 5 sections:
Communications
1.Word usage and vocabulary
2.Grammar/punctuation
3.Writing skills
4.Non-verbal communications
5.General communications related to interviewing and client communications
6.General communications related to interoffice office situations
Ethics:
1.Ethical responsibilities centring on performance of delegated work including confidentiality, unauthorized practice of law, legal advice, conflict of interest, billing and client communications
2.Client/public contact including identification as a non-lawyer, advertising and initial client contact 3.Professional Integrity/competence including knowledge of paralegals codes of ethics
4.Relationships with co-workers and support staff
5.Attorney codes/discipline
6.Knowledge of the American Bar Association's Rules of Professional Conduct and the NALA Code of 7.Ethics and Professional Responsibility is required by this examination.
Legal Research:
1.Sources of law including primary authority, secondary authority; understanding how law is recorded
2.Research skills including citing the law; shepardizing, updating decisions; procedural rules of citations Analysis of research problem including identification of relevant facts and legal issues
3.Analysis of research problem including identification of relevant facts and legal issues
Judgement and Analytical Ability:
1.Comprehension of data identifying and understanding a problem
2.Application of knowledge ability to link facts or legal issues from other cases to the problem at hand, recognizing similarities and differences by analogy
3.Evaluating and categorizing data
4.Organizing data and findings in a written document
Substantive Law:
This section is divide in 5 sub-sections. The first sub-section is American Legal system. It includes the following subjects:
1.Court system including their structure and jurisdiction
2.Branches of government, agencies, and concepts such as separation of powers
3.Legal concepts and principles including sources of law, judicial decision making, appellate process
4.Sources and classifications of law including the constitution, statutes, common law, civil law, statutory law and equity law
The other four sub-sections are selected by the candidates out of the following 9 areas:
Administrative Law
Bankruptcy
Business Organizations
Civil Litigation
Contracts
Criminal Law and Procedure
Estate Planning and Probate
Family Law
Real Estate
